Para. 1 Applicability
Commercial relationships between Vossen and the Buyer are subject exclusively to the following General Terms & Conditions as amended in force at the time the order is placed. No deviating conditions claimed by the Buyer will be recognised by Vossen unless they have been expressly agreed to by Vossen in advance and in writing. Orders will only be accepted from persons aged 18 and above.
Para. 2 Conclusion of the contract and right of cancellation
Vossen undertakes to accept the Buyer's order in compliance with the Terms & Conditions published on the website. In the event of typing errors, printing errors, calculation errors and omissions, Vossen reserves the right to cancel the contract. The Contract of Sale only becomes effective after Vossen has accepted the order by delivering the goods ordered or notifying the Buyer of impending delivery
(= confirmation of order). Private individuals are entitled to withdraw from the contract as defined by the provisions of the Austrian Consumer Protection Law (KSCHG). This right of cancellation is valid for up to 14 days after receipt of the goods. Please note the details on the return form enclosed with the goods. In the event you opt to return the goods, all or part of the purchase price will be refunded (but not the postage costs) relative to the goods returned by the buyer. The costs of returning the goods to us are to be borne by the buyer.
Para. 3 Terms of delivery, shipping costs
Unless otherwise agreed, delivery will be by post. Deliveries to the Buyer will be effected only to the ordering or delivery address provided by the Buyer when ordering the goods. The Buyer is obliged to ensure that the address details provided are complete and correct. Any additional postage or freight forwarding costs incurred as a result of incomplete or inaccurate address details shall be borne by the Buyer.
The risk of accidental destruction and accidental damage to the goods is deemed to be transferred to the Buyer as soon as the consignment has been handed by Vossen or its agents to the forwarding company, which is deemed to apply also in the event if partial deliveries. Details of delivery periods are deemed to be non-binding unless, in specific cases, the delivery date has been confirmed. Shipping costs per order amount to EUR 5.95 (ex VAT) within Austria and Germany. There is a minimum order value of EUR 20; orders valued at over EUR 80 are shipped free of charge.
Para. 4 Terms & conditions of payment, prices
The Buyer can pay for the goods by cash on delivery or by credit card (Visa, Mastercard, American Express, Diners, JCB). If payment is made by credit card, the Buyer's credit card will be debited immediately after the order process is complete. Vossen reserves the right to make enquiries about the creditworthiness of a Buyer in individual cases. The prices quoted include VAT at 20% (Austria) or 19% (Germany).
Para. 5 Offsetting claims
A buyer is only entitled to offset his claims against unpaid amounts if his claims are legally enforceable as the result of a Court judgement or because Vossen has expressly accepted them.
Para. 6 Retention of title
The goods delivered will remain the property of Vossen until all amounts due from the Buyer have been settled in full. The Buyer is liable for all and any costs incurred by Vossen in exercising its right to retention of title.
Para. 7 Warranty
Warranty claims are to be made in accordance with current legislation.
Para. 8 Applicable law
The contractual agreement is subject to Austrian law.
